Terms & Conditions
Please read before registering, submitting a project, or accepting reviewed pricing. Keep a copy with your order records.
1. Our business and these terms
B&V 3D provides additive manufacturing, model-based prototyping, short production runs, and finished printed products. We aim for thoughtful material selection, clear communication, and high-quality workmanship. Our website helps customers explore a project, provide files, obtain a working estimate, and follow review and order progress. These Terms & Conditions govern use of this website and direct transactions with B&V 3D, together with any final written quotation, invoice, and project specifications we expressly accept. Etsy transactions also remain subject to the applicable listing, Etsy checkout terms, and marketplace policies. These terms do not expand a service beyond what is expressly included in your order.
2. Eligibility and authority
You must be legally able to enter the transaction, or act with the authorization of a parent, guardian, or organization that can do so. Account registration and direct ordering are intended for adults. If you act for an organization, you represent that you have authority to provide its designs, approve specifications, accept prices, and authorize purchases. Do not create an account in another person’s name, misrepresent ownership of a design, or submit a project you are not authorized to commission. Parents and caregivers remain responsible for selecting and supervising use of products by children.
3. The quote-to-order process
The normal direct-order sequence is: upload a model and select requested print settings; provide contact and shipping details; acknowledge these terms and submit a request; allow B&V 3D to review geometry, intended use, material availability, manufacturability, finishing, and shipping; review any revised price and additional fees; accept the reviewed quote; receive an invoice and arrange payment; and receive production and fulfillment updates. Acceptance of a reviewed quote is not itself a payment and does not start production. We may prepare a work order or schedule provisionally while holding the job for payment. You may request a payment receipt and use your verified account to view recorded status and updates.
4. Automated estimates are preliminary
Browser previews and automatic calculations are planning tools. Estimated volume, print time, material usage, dimensions, supports, shipping, and prices may differ from the final production plan. Mesh errors, hidden surfaces, units, orientation, support removal, infill, tolerances, multiple bodies, packaging, and handling can affect a job. A displayed estimate is not an unconditional offer to manufacture at that price. We may correct calculation errors and decline requests that cannot be made practically or lawfully. Do not make downstream commitments based solely on a browser estimate.
5. Review, revisions and acceptance
B&V 3D may adjust a proposed price, add identified fees, request clarification, or suggest alternatives before final payment and confirmation. Your account will show a reviewed price when one is issued through the site. Each new price revision requires fresh acceptance; accepting an earlier revision does not accept a later one. Review the total, fees, explanatory notes, quantity, material, delivery address, and any project-specific conditions before accepting. If an invoice differs materially from the accepted scope or price, ask us to resolve the difference before payment. We will not treat a unilateral website edit as authorization for an additional charge.
6. Invoices, payment and production release
The final invoice defines the amount due, applicable taxes, approved scope, and any stated payment conditions. Payments are handled through the invoicing or payment method specified by B&V 3D; do not send card details by email or in quote notes. No lead time is promised and no project should be considered in production until payment receipt is provided or B&V 3D expressly confirms the order has been released for production. A preliminary account status, draft invoice, or estimate is not proof of payment. Where a payment is disputed or reversed, we may pause unfulfilled work while the matter is resolved, subject to applicable law.
7. Scheduling and lead times
Any lead time stated before final project confirmation is an estimate unless we expressly agree otherwise in writing. Timing may depend on materials, machine availability, project clarification, payment, testing, reprints, finishing, and carrier conditions. We may revise an estimated schedule when those conditions change and will communicate material changes through available contact channels. A rush request is not accepted unless confirmed by B&V 3D. We do not promise that a particular date, event, production line, or customer commitment will be met merely because it is mentioned in an upload or message.
8. Customer files and specifications
You are responsible for providing the intended file version, units, quantity, orientation constraints, critical dimensions, fit requirements, intended use, and other specifications that matter to your project. Preview the uploaded file and check the reported scale before submission. Identify threaded features, press fits, assembly clearances, flexible features, load paths, and cosmetic surfaces in writing. Silence does not establish a special tolerance or certification requirement. Files requiring repair, conversion, redesign, or engineering work may require a separate fee and approval. Keep your own master files and backups; the website is not an archival design-storage service.
9. Manufacturing variation and quality
Layer lines, seams, support marks, minor surface variations, color differences, and direction-dependent strength are inherent characteristics of many printed parts. Photographs and screen colors are illustrative. A material name alone does not establish a specific brand, test rating, formulation, or certified suitability. We review finished parts visually unless additional inspection is included in the agreed scope. A visual review is not destructive testing, dimensional certification, or validation for every possible use. Specific tolerances, inspection methods, cosmetic requirements, and acceptance criteria should be agreed before payment and may affect pricing.
10. Prototypes and engineering boundaries
A prototype, fit-check model, replacement part, or functional component is supplied for the scope expressly agreed. Manufacturing a customer design does not by itself constitute engineering approval, professional engineering services, regulatory certification, or a determination that the design is safe for a particular application. Unless we expressly agree to defined testing or design services, the customer is responsible for independent evaluation, assembly compatibility, adequate safety factors, and qualification in the intended environment. Descriptions such as precision or high quality describe our manufacturing focus and do not promise an unstated certification or performance threshold.
11. Use limitations and handling
Printed parts may soften, deform, crack, wear, or lose strength when exposed to heat, ultraviolet light, moisture, chemicals, repeated stress, impact, or unsuitable loads. Keep products away from conditions not approved for the selected material and application. Small parts, broken pieces, magnets, or other components can present hazards; follow the product’s actual labeling and age guidance. Do not assume a print is suitable for food contact, medical use, electrical insulation, pressure containment, protective equipment, vehicle safety systems, or other safety-critical service. Such applications require specific prior written agreement and appropriate validation. Stop using a damaged or unsafe product.
12. Rights in finished products and catalog designs
B&V 3D may produce and sell products through Etsy, this website, and other channels where it has the necessary rights. Those rights may arise from our original design work, a purchased or leased commercial license, an active authorized subscription, written permission from a rights holder, or another valid legal basis. Rights can differ by model, designer, license period, sales channel, and intended use. Purchasing a physical product does not transfer ownership of the underlying digital design or grant the buyer permission to reproduce or commercially exploit it. Third-party names, designs, and trademarks remain with their respective owners.
13. Customer design permissions
By submitting a file, you represent that you own it or have permission sufficient for B&V 3D to review, reproduce, modify as authorized, and manufacture the requested items for the stated purpose. A freely downloadable model is not necessarily licensed for commercial printing. You agree to provide a source, license, or written authorization when reasonably requested. B&V 3D may decline, pause, or cancel a request where rights are unclear or disputed. You grant only the permissions reasonably needed to quote and fulfill your request, handle support, and keep business records; submission alone does not grant us a general right to list your original design for resale or publish confidential project images.
14. Confidentiality and submitted information
Do not submit regulated, classified, export-controlled, or exceptionally sensitive information without a separate arrangement accepted in writing. No nondisclosure agreement arises solely from a file upload. We use project information to review and fulfill requests and may involve appropriate service providers in that work. If confidentiality requirements are important, resolve them before sending the design. Contact us before uploading a file subject to special contractual restrictions. Our Privacy Notice explains the handling of personal information; intellectual-property permission and personal-data consent are separate questions.
15. Prohibited requests and website misuse
Do not use the site to submit unlawful content, infringe rights, impersonate another person, evade access restrictions, distribute malware, probe unauthorized systems, or interfere with other users. Do not attempt to manipulate quote calculations, shipping inputs, payment amounts, account permissions, or stored records. We may reject files that appear malicious, malformed, impractical, or inconsistent with the available service. We may limit automated requests and take proportionate action to protect the site, customers, and business. A security restriction does not eliminate a customer’s legally protected rights relating to an existing transaction.
16. Accounts, security and administration
Keep your password private and use an email address you control. Verified access is required to claim account history and accept revised quotes. B&V 3D may correct records, restrict access, disable or remove accounts, manage quotes and orders, and block abusive registration attempts for legitimate operational, security, or legal reasons. Deleting an account does not automatically delete transaction records, cancel a paid order, or extinguish a valid claim. We may retain limited quote-number and deletion records to prevent duplicate references and support accountability. Shared networks may be affected by IP restrictions; contact us if you believe a restriction is mistaken.
17. Order changes and customer cancellation
Request changes or cancellation promptly using your quote or order reference. A changed file, material, quantity, address, or specification may require a new review, revised price, and renewed approval. Once materials have been committed or manufacturing has begun, cancellation or changes may not be practical. Any charge for authorized work already performed, custom materials, or a nonrefundable deposit must follow the terms disclosed for that order and applicable law. We do not impose an undisclosed cancellation charge simply because a customer asks a question or declines an unaccepted price revision.
18. Cancellation by B&V 3D and refunds
B&V 3D may decline or cancel work where necessary or appropriate, including for manufacturing limitations, supply problems, pricing errors, suspected fraud, rights concerns, prohibited use, or inability to agree on specifications. If we cancel an unfulfilled paid order, we will notify you and arrange the refund due for the unfulfilled portion, subject to applicable law and any valid written allocation for completed authorized work. We will not use a general reservation of discretion to retain payment for goods or services we are obligated to refund. Refund timing also depends on the payment provider. Partial fulfillment and any related remedy will be addressed based on the actual order.
19. Shipping and delivery
Shipping options and automated rates are estimates until the package and final invoice are confirmed. You are responsible for an accurate, deliverable address and for notifying us promptly of errors. Tracking may not update immediately and carrier delivery dates may be estimates. If a parcel is missing, delayed, or damaged, contact us so we can review tracking, packaging, and available remedies. Applicable law and any confirmed delivery commitment govern responsibility; a tracking scan does not automatically eliminate every delivery-related claim. We do not guarantee a carrier’s performance or immunity from delays beyond our control.
20. Inspection, concerns and remedies
Inspect delivered items promptly and contact b.and.v3d@gmail.com with the order reference, a description of the concern, and useful photographs. Retain packaging when relevant to a shipping claim. We may ask for reasonable information or return of an item to assess the issue. The appropriate response may include clarification, repair, replacement, a partial refund, or another remedy based on the agreed specifications and applicable rights. The site does not create an unconditional satisfaction guarantee or an automatic free redesign service. Nothing in these terms shortens a mandatory legal claim period or removes a remedy that cannot lawfully be excluded.
21. Warranty boundaries
We do not make an additional general promise that a customer design, prototype, or catalog item will satisfy every purpose, fit every assembly, or perform indefinitely. Any express project warranty must be identified in the order or otherwise arise under applicable law. To the extent legally permitted, no additional implied warranty is offered beyond those that apply to the transaction. THIS LANGUAGE DOES NOT DISCLAIM NONWAIVABLE CONSUMER WARRANTIES, CONTRADICT AN EXPRESS WARRANTY, OR CONVERT EVERY SALE INTO AN AS-IS SALE. Any lawful order-specific disclaimer must meet the notice and other requirements that apply to that sale.
22. Limitations of responsibility
To the maximum extent permitted by applicable law, B&V 3D is not responsible for indirect, incidental, special, or consequential losses arising from use of a product or service, such as lost production, lost profits, or loss caused by an unapproved application. Where enforceable, our aggregate contractual liability for an affected order is limited to the amount paid for that order. These limitations do not exclude or limit liability where doing so is prohibited, including mandatory consumer remedies or liability that cannot be waived for the conduct involved. They are not a promise that a court will enforce every limitation in every circumstance.
23. Claims involving customer-supplied material
Where legally permitted, a customer that supplies infringing or unlawful material is responsible for losses reasonably attributable to that breach, including reasonable costs of responding to a third-party claim. This provision does not make the customer responsible for B&V 3D’s independent misconduct or require a consumer to waive nonwaivable rights. We will provide reasonable notice of a claim for which we seek reimbursement and allow appropriate cooperation in resolving it. No settlement imposing a new admission, payment obligation, or nonmonetary duty on the customer will bind that customer without appropriate agreement or legal authority.
24. Service availability and communications
The website may be unavailable during maintenance, service outages, or events beyond reasonable control. Account status reflects recorded updates and is not continuous machine telemetry. Email notifications are attempted when supported events occur, but delivery may be delayed or filtered; check your account and contact us if an expected update is missing. We do not promise uninterrupted access or error-free estimates. Our external service providers, Etsy, and invoicing platforms have their own terms. Links to educational resources are provided for convenience and do not establish affiliation or endorsement of every statement on an external site.
25. Changes to terms and transaction records
We may update these terms for future use and future transactions. The version displayed with a new registration, quote submission, or price acceptance is relevant to that action. Material changes do not retroactively rewrite an already agreed paid order without a valid basis or agreement. We may correct mistakes and change proposed sale terms or costs before final payment, with the resulting scope and amount defined in the final invoice and any accepted written project terms. Save a copy of the terms and invoice you rely on. Project-specific written commitments control over inconsistent general website copy to the extent legally permitted.
26. Governing law, disputes and contact
These terms are intended to be interpreted under Minnesota law, except where another jurisdiction’s mandatory protections or applicable federal law govern. We encourage you to contact us first with a clear description and relevant records so we can attempt a practical resolution. These terms do not impose mandatory arbitration, waive access to small-claims procedures, or prevent a complaint to a regulator. If one provision is unenforceable, the remaining provisions continue to the extent permitted. Failure to enforce a provision once does not waive it permanently. Questions about terms, an invoice, rights in a design, an account restriction, or an order should be sent to b.and.v3d@gmail.com.
